1.  DEFINITIONS
The ‘client’ refers to the person who signs this agreement.  ‘Photographs’ means all photographic material furnished by the photographer.

2.  COPYRIGHT
The entire copyright in the photographs is retained by the photographer at all times throughout the world.  The photographs must not be copied or stored by electronic means by any other than the client without the written permission of the photographer.  Manipulation of images or use of only a portion of the image may only take place with the written permission of the photographer.

3.  OWNERSHIP OF MATERIALS
Title to all the photographs remains the property of the photographer.

4.  USE
The client has a licence to use the photographs for an unlimited period of time, which only comes into effect when payment in full of the relevant invoice has taken place.  No use must be made of the photographs before payment has been received.

5.  EXCLUSIVITY
The photographer retains the right in all cases to use the photographs in any manner at any time and in any part of the world for the purpose of advertising or otherwise promoting his/her work.

6.  CONFIDENTIALITY
The photographer will keep confidential and not disclose to any third parties or make use of material or information communicated to him/her in confidence for the purposes of the photography, save as may be reasonably necessary to enable the photographer to carry out his/her obligations in relation to the commission.

7.  PAYMENT
A non-returnable deposit of £250 will be payable on booking.  The remainder of payment will be due on receipt by the client of the photographs on CD.  Any further orders of Albums or Canvases will be payable at the time of order.

8.  EXPENSES
Where extra expenses are incurred by the photographer as a result of alterations to the original brief by the client, the photographer will be entitled to charge an extra sum at the normal rate.  The client will be advised of the extra charge in advance.

9.  REJECTION
There is no right to reject the photographs on the basis of style or composition

10.  CANCELLATION & POSTPONEMENT
If a cancellation takes place before six calendar months from the date of the wedding the non-refundable deposit paid will be forfeited.  A cancellation within three calendar months of the wedding will attract a cancellation fee of £600, less the deposit paid. Postponement fees may be negotiated but the non-refundable deposit will be forfeited as a minimum. 

11.  APPLICABLE LAW
This agreement shall be governed by the laws of England & Wales.

12. VARIATION
These Terms & Conditions shall not be varied except by agreement in writing.
